These Terms of Service (“Terms”) govern your use of websites and other web services (“the Services”) operated by the New Zealand National Party (the “NZNP”, “National”, “National Party”, “we” or “us”). Your use of the Services constitutes agreement to these Terms. If you do not agree to these Terms, you must not use the Services.

We may revise these Terms from time to time. If we make any changes to these Terms, we will update the “Last Revised” date at the top of these Terms. Any changes to these Terms are effective immediately, and your continued use of the Services confirms your acceptance of any changes. If you do not agree to any changes to these Terms, you must stop using the Services.

Ownership and Licences

The Services, including the text, graphics, videos, photographs, images, and other content contained therein, are owned by the New Zealand National Party or our licensors and are protected under New Zealand copyright law. Except where explicitly stated otherwise in these Terms, all rights to and concerning the Services are reserved by us or our licensors.

Subject to your compliance with these Terms, you are hereby granted a limited, non-transferable, non-exclusive, revocable licence to access and use the Services for your own personal and non-commercial use. Any use of the Services other than as authorised, without the prior written permission of the New Zealand National Party is strictly prohibited, violates our intellectual property rights, and terminates your licence to use our Services.

Trademarks

“The New Zealand National Party”, “National” and our logos, design assets, slogans, product and service names, and the appearance of the Services are trademarks of the New Zealand National Party and may not copied or otherwise used, in entirety or in part, without the prior written permission of the New Zealand National Party.

Any other trademarks, product or service names, and company names or logos mentioned on or included within the Services are the property of their respective owners in accordance with law. Any reference made to products, services, or other information, by any means, is not to be considered an endorsement or recommendation by the New Zealand National Party.

Feedback

You may share with us any questions, comments, suggestions, ideas or information about the New Zealand National Party or the Services (“Feedback”). You understand that we may use such Feedback for any purpose, without acknowledgement or compensation.

Third-Party Content

The Services may contain information about third-party products, services, events or other material. (“Third-Party Content”). Your engagement with third parties or use of any Third-Party content is solely between you and the applicable third party. The New Zealand National Party does not make any representations or warranties regarding any Third-Party Content. Your access and use of any Third-Party Content is at your own risk.

Prohibited Activities and Conduct

You will not contravene any law, intellectual property right, contract or any other third-party right in your use of the Services. You have the sole responsibility for your conduct while using the Services.

You will not:

  • behave in a manner that threatens, harasses or intimidates any person;

  • impersonate or otherwise misrepresent your affiliation with any person or other entity;

  • engage in any commercial use of the Services;

  • use any data mining, robots, or other data gathering or extraction methods employed to scrape data from the Services;

  • copy, reproduce, distribute, publicly perform, or publicly display the Services, in whole or in part, without the express written permission of the New Zealand National Party;

  • use the Services other than for their intended purpose or in any manner that could interfere with, disrupt, negatively affect or inhibit other users from fully enjoying the Services or that could damage, disable, overburden, or impair the functioning of the Services in any manner;

  • reverse engineer any part of the Services or do anything that might reveal source code or circumvent any measure employed to prevent or restrict access to any part of the Services;

  • develop or use any applications that interact with the Services without the prior written consent of the New Zealand National Party; or

  • use the Services for any illegal or unauthorised purpose, or for any activity in violation of these Terms.

Use of mobile communications

If you opt to receive updates or other information from us by text message, you consent to us communicating with you via your mobile phone. We do not charge for this, however your mobile provider’s normal messaging, data, and other rates and fees will still apply. You should contact your mobile provider for the full details of any rates and fees that may apply.

Disclaimer

Your use of the Services is at your own risk. Except where expressly provided otherwise in writing by the New Zealand National Party, the Services and any content therein are provided “as is” and “as available”. The New Zealand National Party does not represent or warrant that the Services or any content therein are complete, current or free from error.

Indemnity

To the greatest extent permitted by applicable law, you will indemnify and hold harmless the New Zealand National Party and its officials, Members of Parliament, employees, volunteers and agents, from and against any claims, damages, costs, liabilities and expenses in connection with your access to and use of the Services.

Continuity of the Services

We reserve the right to modify or to stop providing all or part of the Services at any time and without any prior notice. The New Zealand National Party is not responsible for any loss or harm arising from your inability to access or use the Services.

Severability

If any provision of these Terms or part thereof is deemed unlawful, void or otherwise unenforceable, that provision or part is severable from these Terms and will not affect the validity and enforceability of any other provisions herein.

Enforcement

In the event that the New Zealand National Party does not enforce a provision of these Terms, such lack of enforcement is not to be deemed a waiver of future enforcement of that provision or any other provision of these terms, unless this is expressly waived in writing by the New Zealand National Party.
